BASIC RIGHTS PROTECTED BY THE NATIONAL LABOR RELATIONS ACT

KNOW YOUR RIGHTS SO TOGETHER WE CAN ENSURE THEIR PROTECTION

Employee Rights under Section 7 of the Act:

v Right to form, join or assist labor organizations

v Right to bargain collectively through employees’ chosen representative

v Right to engage in other concerted activities, for mutual aid or protection

v Right to distribute and receive union literature

Other employee protections under the Act:

v Right not to work under abnormally dangerous working conditions

v Right to union representation during interviews which may lead to discipline (see section on Weingarten Rights)

v Right to strike and engage in peaceful picketing (may be limited by your contract.)

Employer actions that are prohibited unfair labor practices under Section 8(a) of the Act:

v Interfering with, restraining, or coercing employees in the exercise of their rights under Section 7

v Threatening employees with the loss of jobs or benefits if they join or vote for a union or engage in protected concerted activity

v Questioning employees about their union sympathies or activities in ways that interfere with, restrain, or coerce employees in the exercise of their rights under the Act

v Favoring employees who don’t support the union over those that do in promotions, job assignments, wages, hours, enforcement of rules, or any other working conditions

v Promising benefits to employees to discourage their union support

v Dominating or interfering with the formation or administration of any labor organization

v Discriminating in regard to hire or terms or conditions of employment for the purpose of encouraging or discouraging union membership

v Discharging or discriminating against employees for filing unfair labor practice charges or testifying in NLRB proceedings

IF YOU BELIEVE ANY OF YOUR RIGHTS UNDER THE NLRA HAVE BEEN VIOLATED, TALK TO YOUR UNION REP OR SOMEONE AT THE UNION IMMEDIATELY ABOUT FILING UNFAIR LABOR PRACTICE CHARGES WITH THE NLRB.
